Terms of Use
Effective 30 October 2026
In short: the viewer is free. Pro is a subscription you buy in the Microsoft Store, after a 14-day trial with no payment. The pictures you open are yours, and we claim nothing in them. Nothing in these terms takes away your rights as a consumer.
1. Who we are
Cobaltsmith is the brand of Anton Lazouski, a sole trader registered in Poland (ul. Gerberowa 20/19, 52-221 Wrocław; NIP 8992897077; REGON 388636852; [email protected]) — "we" and "us" in these terms. See the Legal notice.
2. What these terms cover
These terms apply to the website cobaltsmith.com and to the Cobalt Photo app for Windows. By using the website or the app you accept them. How we handle personal data is described in the Privacy Policy.
3. The app and its licence
Cobalt Photo is available only through the Microsoft Store. Your licence to use it is governed by the Microsoft Store Standard Application License Terms, and buying it by Microsoft's terms of sale. These terms add the details below; where they differ, Microsoft's terms apply to the purchase and these terms to everything else.
You may install and use Cobalt Photo on the devices the Microsoft Store allows for your Microsoft account, for private and for work purposes. You may not sell, rent or redistribute the app, remove its notices, or decompile it — except where the law allows this regardless of these terms.
4. The free viewer, the trial and Pro
- The viewer is free, with no time limit and no advertising.
- The Pro trial: the first time you start Cobalt Photo, all Pro features are free for 14 days, without any payment details. The trial ends by itself; nothing is charged.
- Pro is a subscription, monthly or yearly, bought in the Microsoft Store at the price it shows for your country, taxes included. It renews automatically for the same period until you cancel it.
- Cancelling: any time in your Microsoft account, under Services & subscriptions. Pro keeps working until the end of the period you have paid for; after it, the free viewer goes on working.
- Payments, refunds and your right of withdrawal as a consumer are handled by Microsoft, which sells the subscription, under its terms of sale.
We may add features, change how they work or, for good reason such as a change in Windows, remove one. If a change significantly reduces what Pro gives you, we will say so in advance, and you can cancel before it applies.
5. Your pictures
Cobalt Photo works with your files on your computer. The pictures you open, edit and convert stay yours; we do not claim any rights in them and do not receive them. You decide what the app does with your files — for example whether it saves a copy or replaces the original. Keep backups of pictures that matter to you: like any software, Cobalt Photo can contain errors, and a replaced original can be brought back only while the app still keeps its backup (one week).
6. What is ours
Cobalt Photo, this website, the documentation, the name Cobaltsmith and the logos are protected by copyright and other laws and belong to us. Cobalt Photo includes open-source components and map data that are used under their own licences; their notices come with the app. The photos on this website are credited on the Credits page.
7. Using the website
The website describes our products. Do not misuse it — for example by attacking it, overloading it or copying its contents to pass them off as your own. Links to other sites are given for convenience; we are not responsible for their content.
8. Your rights as a consumer
If you are a consumer, you have the statutory rights given by the law of your country, including the rights for digital content that does not conform to the contract (Directive (EU) 2019/770 and the national laws implementing it). Nothing in these terms limits them.
If Cobalt Photo does not work as described, please tell us at [email protected]: what is wrong and, if you can, how to see it. We reply to every complaint within 14 days.
9. Liability
We make Cobalt Photo with care, but we cannot promise that it will be free of errors or suit every purpose. We are not liable for loss of data you could have avoided by keeping backups, or for damage that was not foreseeable.
Nothing in these terms limits or excludes our liability where the law does not allow it to be limited — in particular for damage caused intentionally or through gross negligence, for injury to life, body or health, or under mandatory consumer law. If you use Cobalt Photo for your business, our liability is limited, as far as the law allows, to the amount you paid for Pro in the 12 months before the damage.
10. Law and disputes
These terms are governed by Polish law. If you are a consumer, you also keep the protection of the mandatory provisions of the law of the country where you live, and you may bring a claim in the courts of your country. If you live in Poland, you can also ask for help free of charge from your municipal or district consumer ombudsman (rzecznik konsumentów) or the Trade Inspection (Inspekcja Handlowa).
11. Changes to these terms
We may change these terms, for example when Cobalt Photo or the law changes. The new version applies from the date shown at the top. If a change is to your disadvantage and you have a Pro subscription, we will tell you in the app before it applies; you can cancel the subscription if you do not agree.
These terms are published in several languages. If they differ, the English version prevails, unless the law of your country requires otherwise.
